The following are our fees under the Fixed-Fee Debt Recovery Service only. The service is only available for claims which are under a value of £10,000.00 and are uncontested and undisputed.

Work under our fixed-fee service will be carried out by a paralegal and supervised by a Partner. Please see Our Team for further details.

 Stage 1

 Our fee for preparing and issuing the letter of a claim under the Fixed-Fee Debt Recovery Service is a universal fee of £50.00 plus VAT.

The fee includes:

  • taking your instructions and reviewing documentation
  • undertaking appropriate searches
  • drafting the letter of claim and making any amendments as you see fit
  • preparing and sending the letter of claim with relevant attachments
  • where the debtor proposes a settlement, we will take your further instructions and liaise with the debtor regarding settlement

The fee does not include:

  • If a debtor replies contesting the debt, additional costs will be payable for engaging in further communications with the debtor under the fixed-fee, above and subsequent time spent will be chargeable on an hourly rate basis.

Timescales:

  • Once the letter of claim is sent, the debtor will either have 30 days (if an individual) or 14 days (if a business) to respond to the letter or make payment.

Stage 2

 We operate a fixed-fee for preparing and issuing a claim in the court which is dependent upon the value of the claim. The following fees are to include all work in preparing and submitting the claim to the court:

  • £250.00 to £499.99: £50.00 plus VAT
  • £500.00 to £749.99: £75.00 plus VAT
  • £750.00 to £999.99: £100.00 plus VAT
  • £1,000.00 to £2499.99: £125.00 plus VAT
  • £2,500.00 to £4,999.99: £150.00 plus VAT
  • £5,000.00 to £7,499.00: £200.00 plus VAT
  • £7,500.00 to £9,999.99: £250.00 plus VAT

The fee includes:

  • taking your instructions and reviewing documentation
  • undertaking appropriate searches
  • drafting the claim form and making amendments as you see fit
  • drafting the particulars of claim and making amendments as you see fit
  • preparing and sending the claim to the court with relevant attachments
  • where the debtor proposes a settlement, we will take your further instructions and liaise with the debtor regarding settlement

The fee does not include:

  • if a debtor replies contesting the debt, additional costs will be payable for engaging in further communications with the debtor under the fixed-fee, above and subsequent time spent will be chargeable on an hourly rate basis.

Disbursements

 The court will charge an issue fee which is also based upon the value of the claim as follows:

  • up to £300.00: £35.00 inc. VAT
  • £300.01 to £500.00: £50.00 inc. VAT
  • £500.01 to £1,000.00: £70.00 inc. VAT
  • £1,000.01 to £1,500.00: £80.00 inc. VAT
  • £1,500.01 to £3,000.00: £115.00 inc. VAT
  • £3,000.01 to £5,000.00: £205.00 inc. VAT
  • £5,000.01 to £10,000.00: £455.00 inc. VAT

Please note: the court fee is recoverable from the debtor and can be added to the overall claimed amount.

Timescales:

  • the defendant will be given 14 days from service of the claim form in which to acknowledge, defend or pay the claim. If the defendant returns an acknowledgement of service, the defendant will have a further 14 days to file a defence or make payment.

 Stage 3

 Our fee for requesting default judgment under the Fixed Fee Debt Recovery Service is a universal fee of £35.00 plus VAT.

The fee includes:-

  • preparing and filing the request for judgment application with the court
  • writing to the debtor with a copy of the judgment requesting payment
  • where the debtor proposes a settlement, we will take your further instructions and liaise with the debtor regarding settlement

The fee does not include:

  • If a debtor replies contesting the debt, additional costs will be payable for engaging in further communications with the debtor under the fixed-fee, above and subsequent time spent will be chargeable on an hourly rate basis.

 Timescales:

  • Once a judgment is provided, the defendant will have one month to pay the judgment debt before the CCJ is registered against their name. If the judgment is settled during that one month period, the defendant may apply for the CCJ to be cancelled.

Stage 4

Our fixed fees for enforcement options are varied and again dependant on the value of the claim. All fees are inclusive of all work and correspondence involved with the application. The following fees are applicable.

Instruction of bailiffs

  • £250.00 to £999.99: £60.00 plus VAT (re-issue at £25.00 plus VAT)
  • £1,000.00 to £4,999.99: £65.00 plus VAT (re-issue at £25.00 plus VAT)
  • £5,000.00 to £9,999.99: £75.00 plus VAT (re-issue at £25.00 plus VAT)

Disbursements: the court will charge an issue fee which is £110.00 inc. VAT.

Instruction of High Court Enforcement Officers:

  • £600.00 to £999.99: £75.00 plus VAT
  • £1,000.00 to £4,999.99: £85.00 plus VAT
  • £5,000.00 to £9,999.99: £100.00 plus VAT

Disbursements: the court will charge an issue fee which is £66.00 inc. VAT.

Order to provide information/questioning

  • £250.00 to £999.99: £150.00 plus VAT
  • £1,000.00 to £9,999.99: £200.00 plus VAT

Disbursements: the court will charge an issue fee which is as follows:

  • to issue an application for an order for a debtor or other person to attend court to provide information: £55.00 inc. VAT
  • to request Bailiff service of an order for a debtor to attend court for questioning: £110.00 inc. VAT

 Attachment of Earning Order

  • £250.00 to £999.99: £100.00 plus VAT
  • £1,000.00 to £4,999.99: £110.00 plus VAT
  • £5,000.00 to £9,999.99: £125.00 plus VAT

Disbursements: the court will charge an issue fee which is £110.00 inc. VAT.

Third-Party Debt Order

  • £250.00 to £999.99: £150.00 plus VAT
  • £1,000.00 to £9,999.99: £200.00 plus VAT

Disbursements: the court will charge an issue fee which is £110.00 inc. VAT.

The fee includes:

  • considering your options, advising on the best course of action and taking instructions
  • preparing and sending the relevant application to be sent to court
  • liaising with the court regarding progress throughout

The fee does not include:

  • further correspondence with the debtor following submission of the relevant application save for where the debtor makes contact to in order to make payment

Timescales:

  • timescales for enforcement proceedings can vary and your legal advisor will keep you updated on progress.

Claims over £10,000 or claims which are defended and disputed

 If a claim is over £10,000 or is disputed and defended, the fixed-fees above will not apply.

If the claim is disputed, or you have reason to believe that the claim will be disputed, work will be chargeable on an hourly rate basis. An estimate of time will be given, dependant on the complexity and documentation to review, and will be based on one of the following hourly rates:

  • Sue Scrace – Chartered Legal Executive: £200.00 plus VAT per hour
  • Jordan Griffiths – Paralegal: £100.00 plus VAT per hour.

Claims over £10,000 up to £25,000 are likely to be allocated to the fast track by the court (where the court hearing can only last for 1 day and where it can take up to a year to reach a hearing). Claims over £25,000 are likely to be allocated to the multitrack by the court (where, usually, more than 1 day is allowed for a hearing but, depending upon the complexity of the case, it can take between 1 and 2 years to reach a hearing). Legal fees for claims on these tracks may be recoverable from the debtor.

Disbursements: court fees for claims over a value of £10,000.00 are as follows:

  • £10,000.01 to £200,000.00: 5% of the value of the claim.
  • £200,000.01 and above: £10,000.00 inc. VAT.
